Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and FitCart ("we", "us", or "our") governing your access to and use of the FitCart iOS application and website (collectively, the "Service"). Please read them carefully.
Eligibility
You must be at least 13 years old to use FitCart. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. By using FitCart, you confirm that you meet these requirements.
FitCart is currently available only in the United States. Use from other jurisdictions is at your own risk and subject to local laws.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and current information when creating your account.
- Notify us immediately at [email protected] if you suspect unauthorised access to your account.
- Not share your account with or transfer it to any other person.
We reserve the right to suspend or terminate accounts that violate these Terms.
The Service
FitCart provides an AI-powered meal planning and grocery ordering platform that allows you to:
- Generate personalised weekly meal plans based on your health goals and dietary preferences.
- Automatically build grocery lists from your meal plan.
- Order groceries through integrated third-party delivery services (e.g., Instacart).
- Track your pantry inventory and nutritional intake.
- Optionally sync data with Apple Health.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
Subscriptions & Billing
FitCart may offer free and paid subscription tiers. Paid subscriptions are billed through the Apple App Store and are subject to Apple's payment terms.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
- Cancellation: You may cancel at any time via your Apple ID account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued.
- Refunds: Refund requests are handled by Apple in accordance with their refund policy.
- Price changes: We will notify you at least 30 days in advance of any price increase. Continued use after the effective date constitutes acceptance.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse-engineer, decompile, or disassemble any part of the app.
- Scrape, crawl, or systematically extract data from the Service.
- Introduce malware, viruses, or any other harmful code.
- Attempt to gain unauthorised access to our systems or other users' accounts.
- Use the Service to send spam or unsolicited messages.
- Impersonate any person or entity.
Violations may result in immediate account termination and, where applicable, legal action.
Health Disclaimer
The meal plans, calorie targets, and nutritional information provided by FitCart are generated by AI and are intended for general wellness purposes only. They do not constitute medical advice, diagnosis, or treatment.
We make no warranty that the nutritional information is complete, accurate, or suitable for your specific health needs. You assume full responsibility for how you use the information provided by the Service.
Third-Party Services
FitCart integrates with third-party services including Instacart and Apple Health. When you use these integrations:
- You are also subject to the terms and privacy policies of those third parties.
- We are not responsible for the availability, accuracy, or conduct of third-party services.
- Grocery orders placed through third-party delivery services are governed by those services' terms, including their fulfilment, refund, and delivery policies.
FitCart is not affiliated with, endorsed by, or sponsored by Instacart or Apple unless explicitly stated.
Intellectual Property
All content, features, and functionality of FitCart — including but not limited to the app design, logo, text, graphics, and code — are owned by FitCart and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial purposes. This licence does not include the right to sublicense, sell, or commercially exploit any part of the Service.
User Content
You retain ownership of any content you submit to FitCart (e.g., pantry items, food preferences, feedback). By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process it solely for the purpose of providing and improving the Service.
You represent that you have the right to submit any content you provide and that it does not violate any third-party rights.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any nutritional information provided.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITCART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FITCART IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.
Termination
You may stop using FitCart and delete your account at any time from within the app (Profile → Settings → Delete Account).
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, without prior notice. Upon termination:
- Your right to use the Service ceases immediately.
- We will delete your personal data in accordance with our Privacy Policy.
- Any outstanding subscription fees remain due.
Sections that by their nature should survive termination (Disclaimers, Limitation of Liability, Governing Law) will continue to apply.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification or email at least 14 days before the changes take effect. The "Last updated" date at the top reflects the most recent revision.
Continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
